Marketing & Consent

Scope of Our Marketing Communications

At Bautven, we engage with our customers through various commercial electronic messages (CEMs) to keep you informed and engaged with our brand. Our marketing communications include newsletters, promotional campaigns, product launches, cart-recovery sequences, and surveys. We may also send SMS offers if you have opted in for such communications.

It is important to distinguish our marketing communications from strictly transactional messages. Transactional communications, such as order confirmations, shipping updates, and password reset emails, are not considered CEMs under Canada's Anti-Spam Legislation (CASL) and are sent as part of our service commitment to you.

How We Collect Consent (CASL §6)

We collect consent for our marketing communications through several touchpoints:

  • Newsletter sign-up forms on our website
  • Checkout opt-in checkboxes (unchecked by default, in compliance with CASL)
  • Pop-up offers
  • Customer service interactions where you express interest in receiving marketing communications

Express consent: You actively indicate agreement by ticking a clearly-labelled, unchecked box to receive our marketing communications.

Implied consent (CASL §10(9)-(10)): Implied consent may apply for up to 24 months after a purchase or 6 months after a written inquiry. We do not assume implied consent beyond these limited grounds.

Sender Identification in Every CEM (CASL §7)

Every commercial electronic message we send identifies us clearly:

  • Legal name: Eugene Allan Bautista
  • Postal address: 1501-2250 Homelands Dr, Mississauga, L5K 1G8, Canada
  • Email contact: bautven@outlook.com
  • Phone: +1 519-430-3341

Refer to our Business Information page for our full legal identity.

Functional Unsubscribe Mechanism (CASL §8 + §9)

Each CEM contains a free, functional unsubscribe link (in emails) or instructions (e.g., reply STOP for SMS). We process unsubscribe requests within 10 business days as required by CASL §9. After processing, you are removed from all promotional lists. Your unsubscribe applies across all marketing from us unless you have granted separate consents for distinct channels.

Alternative channels to unsubscribe include emailing our customer service at bautven@outlook.com or mailing a request to our business address.

Consent Registry (CASL §11)

We maintain a registry of consent events — date, time, channel, method, and the specific text shown at the point of consent — so we can demonstrate compliance if challenged. Records are retained for the minimum period required by CASL (three years from the last marketing action) and our Privacy Policy retention rules. This registry is available for your review upon request to bautven@outlook.com.

Withdrawal of Consent

You may withdraw consent at any time by:

  • Clicking the unsubscribe link in any CEM
  • Replying STOP to any SMS
  • Emailing us at bautven@outlook.com

We process withdrawal within 10 business days. Withdrawing marketing consent does NOT affect order-related communications you continue to receive for purchases you make.

If a Message Was Sent to You in Error

Please contact us at bautven@outlook.com. We will investigate and ensure no further messages are sent.

Penalties (Disclosure)

Violations of CASL may result in administrative monetary penalties of up to CAD 1,000,000 (individual) or CAD 10,000,000 (corporate) per violation. We take CASL compliance seriously.

CRTC Escalation

If you believe we have violated CASL, you may file a complaint with the Spam Reporting Centre at fightspam.gc.ca or contact the CRTC at 1-877-249-CRTC (2782).
